    Terms of accommodation

This is a translation for your convenience. If the English and the Japanese differ, the Japanese version prevails.

    Terms of accommodation

    Article 1 (Scope)

These terms apply to accommodation contracts, and contracts associated with them, at Hygge Haus Kusatsu (604-11 Kusatsu, Kusatsu-machi, Agatsuma-gun, Gunma; "the house"), operated by Eurex Co., Ltd. ("the company"). Where a special agreement exists that does not conflict with law or custom, the special agreement prevails.

    Article 2 (Applying to stay)

When you apply to stay, we ask for your name, dates, expected arrival time and contact details.

A request to extend a stay is treated as a new application.

Personal information is not passed to third parties except where the law requires. It is handled under our privacy policy.

Article 3 (Formation of the contract and payment)

The contract is formed when the house accepts your application.

Bookings made on our official website are paid in advance by the credit card registered at the time of booking. Bookings made through other sites are subject to the terms of that site.

    Article 4 (Refusal and termination)

The house may refuse an application or terminate a contract in the following cases:

    • where there is a risk of conduct contrary to law or public order and morals
    • where a guest has a designated infectious disease, is connected with organised crime, or causes trouble to other guests or the house, including repeated unreasonable demands
    • where natural disaster, failure of facilities or similar makes it impossible to provide accommodation
    • where the house rules are not kept
    • where the conditions of stay set out in the house rules ("The basics of your stay") are not met

    Article 5 (Cancellation)

You may cancel the contract by telling us. Cancellation charges are set out below.

If you have not arrived by 21:00 on the first night of your stay and we have not heard from you, we may treat the contract as cancelled by you.

    Article 6 (Room rates)

Room rates are the plan rates set by the house. Bookings made on our official website are paid in advance; bookings through other sites follow the terms of that site.

The bathing tax (JPY 150 per person per night) is paid at check-in. Charges for services used in the house are paid as you use them or by check-out.

No refund is made if you do not stay after the room has been provided, or if you do not take a meal included in your plan.

    Article 7 (Hours of use)

Check-in is from 15:00 to 21:00, and check-out is by 10:00. Use outside these hours may incur an additional charge.

    Article 8 (House rules)

Guests must keep the house rules set by the house. The conditions for using the baths, the sauna and other facilities are also set out in the house rules.

    Article 9 (Entering rooms)

The house may enter a room without the guest's permission in the following cases:

    • housekeeping such as cleaning, changing towels, collecting rubbish and making beds
    • inspection, repair and maintenance of equipment, appliances, furniture, plumbing and air conditioning
    • where required by law or for safety, or where troublesome conduct has been confirmed
    • where the house judges it necessary to confirm a guest's safety
    • fire, power failure, water leak, disaster or other emergency

    Article 10 (Damages and prohibitions)

If a guest causes loss to the house or a third party, intentionally or by negligence, the guest will compensate for that loss.

The whole property, indoors and out, is non-smoking except in the designated area. If smoking, or smell or scorching caused by smoking, is found in a room or other non-smoking area, we will charge the actual cost of deodorising, cleaning and replacing fittings, and the loss from being unable to sell the room.

With your agreement given at check-in, these costs may be charged to the credit card registered at the time of booking. A guide to the amounts is given in the house rules and at check-in.

    Article 11 (Liability)

Valuables are the guest's own responsibility; the house does not offer safekeeping.

If the house cannot provide a room for reasons attributable to it, it will help arrange alternative accommodation.

The house is a timber building with solid wood throughout. Reasonable sound insulation is in place, but it does not have the complete soundproofing of a concrete building, and in its highland setting the appearance of insects cannot be entirely prevented. The house is not liable for loss arising from these matters, except where it has acted intentionally or with gross negligence. Please deal with insects yourself using the equipment provided.

    Article 12 (General)

If any part of these terms is invalid, the rest remains in force.

Changes to these terms take effect when published on the house's website.

These terms are governed by Japanese law. Any dispute is subject to the exclusive jurisdiction of the Maebashi District Court or the Maebashi Summary Court as the court of first instance.
